Based on the below scenario what would be the correct way to accept the defect? The contract is option C, the contractor is responsible for the design which has been accepted by the project manager. The contractor has since constructed something slightly different to their design but it still complies with the scope. However, as it differs from the accepted design, this will be a defect? To accept the defect, I have two thoughts: the contractor reissues the design matching the as-built for acceptance from the pm, or A change in the scope document by the pm to accept the defect.
